1.INTRODUCTION

In order to provide details of how your personal data is collected and processed by the website(s) of Traci Bray, BS, MA - Medium (otherwise referred to as TBMed), this Privacy Notice has been created for tracibray.com, and any other websites created representing the work and services of TBMed.

Your pledge is that you are 18 years of age or older when providing your data. TBMed controls the data and is responsible for the personal data you provide.

2.  WHAT DATA IS COLLECTED ABOUT YOU, FOR WHAT PURPOSE AND ON WHAT GROUND IT IS  PROCESSED

Personal data equates to  information capable of identifying an individual. It does not include anonymous data.

The following categories of personal data about you may be processed:

  • Communication Data that includes any communication that you send whether that be through the contact form on the website(s), through email, text, social media messaging, social media posting or any other communication that you send. This data is processed for the purposes of communicating with you, for record keeping and for the establishment, pursuance or defense of legal claims. Lawful ground for this processing is of legitimate interests to TBMed which in this case is to reply to communications received, to keep records and to establish, pursue or defend legal claims.
  • Customer Data  If you register with the site(s) of TBMed stored will be your name and email address. When you schedule services, the appointment will be processed by Calendly, which asserts to be GDPR compliant. Your payment details ARE NOT held on the site(s) of TBMed. When you purchase services, you will pay via PayPal as a member of their service, or as their guest. The only payment-based detail held on TBMed’s site(s) is how much you’ve spent and that you paid with PayPal. TBMed never has access to your  bank or card details. PayPal asserts to be GDPR compliant.
  • Signup Data  Constant Contact is the program used by TBMed for sending emails, newsletters, occasional notice of services or programming. It is on this platform that your email sign up information is stored. Unless you have signed up for this using the contact form, we do not otherwise gather or keep your information. For example, if you have scheduled and/or received services, but have not checked the box on the scheduling form to receive emails, or have not filled out the signup form on the website(s), we do not enter your information into the email list kept at Constant Contact. They assert that they are GDPR compliant. You can unsubscribe from emails at any time by hitting the unsubscribe button.
  • User Data includes data about how you use our website and any online services together with any data that you post for publication on the website(s) or through other online services. This data is processed to operate the website(s) and to ensure relevant content is provided to you, to ensure the security of the website(s), to maintain back- ups of  the website(s) and/or databases and to enable publication and administration of the website(s), other online services and business. Lawful ground for this processing is of legitimate interest which in this case is to enable proper administration of the website(s) and business.
  • Technical Data that includes data about your use of the website(s) and online services such as your IP address, your login data, details about your browser, length of visit to pages on the website(s), page views and navigation paths, details about the number of times you use the website(s), time zone settings and other technology on the devices you use to access the website(s). The source of this data is from an analytics tracking system. This data is processed to analyze your use of the website(s) and other online services, to administer and protect TBMed’s business and website(s), to deliver relevant website content and advertisements to you and to understand the effectiveness of advertising.  Lawful ground for this processing is TBMed’s legitimate interest which in this case is to enable the proper administration of the website(s) and business and to grow the business, and to determine marketing strategies.
  • Marketing Data that includes data about your preferences in receiving marketing from TBMed and your communication preferences.  Data is processed to enable you to partake in promotions such as discounted services, to deliver relevant website content and advertisements to you and measure or understand the effectiveness of this advertising. Lawful ground for this processing is a legitimate interest which in this case is to study how customers use products/services, to develop them, to grow the business and to determine marketing strategies..
  • Use of Data Customer Data, User Data, Technical Data and Marketing Data may be used to deliver relevant website content and advertisements to you (including Facebook adverts or other display advertisements) and to measure or understand the effectiveness of the advertising you are served. Lawful ground for this processing is a legitimate interest which is to grow business. Such data may be used to send other marketing communications to you. Lawful ground for this processing is either consent or legitimate interests (namely to grow our business).
  • Sensitive Data  about you is not collected. Sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sexual orientation or practices, political opinions, trade union membership, information about your health and genetic and biometric data. Notes from services are not made, and therefore not kept. We do not collect any information about criminal convictions and offenses.

Where required to collect personal data by law, and you do not provide us with that data when requested, it may be unlikely that performance of service is fulfilled, (for example, to deliver services to you). If you don’t provide the requested data, cancellation of a service you have scheduled may occur. Every effort will be made to notify you at the time.

Your personal data will be used for the purpose it was collected for, or if necessary, for a reasonably compatible purpose. Should further information be required email TBMed at traci@tracibray.com Your personal data may be processed without your knowledge or consent where required or permitted by law. TLBMed does not participate in any automated decision making or automated profiling.

3.  MARKETING COMMUNICATIONS

In signing up for the email list, you have agreed to receive notifications of news, events, channeled messages, and available services and offers. Should you not wish to receive these communications, you may unsubscribe at any time by clicking on the ‘unsubscribe’ button. Should you opt out of receiving these communications, this data does not apply to records of other transactions, or purchases of services. “Unsubscribe” options are available on the electronic communications you receive.

4. DISCLOSURES OF YOUR PERSONAL DATA

We may have to share your personal data with the parties set out below:

  •      Service providers who provide IT and system administration services.
  •      Professional advisers including lawyers, bankers, and auditors  
  •      Governmental bodies that require TLMed to report processing activities.
  •      Third parties to whom we transfer, or merge parts of our business or our assets.

TBMed requires all third parties to whom we transfer your data to respect the security of your personal data and to treat it in accordance with the law. We only allow such third parties to process your personal data for specified purposes and in accordance with our instructions, and to parties that are GDPR compliant.

5. DATA SECURITY

TBMed has put in place security measures to prevent your personal data from being accidentally lost, used, altered, disclosed, or accessed without authorization. TBMed also allows access to your personal data only to those who need to know such data, e.g. the person who manages incoming data for the email/client list. They will only process your personal data on our instructions and they must keep it confidential. TBMed will notify you of any known breach if we are legally required to.

6.  DATA RETENTION

Your personal data will be maintained for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

When deciding what the correct time is to keep the data for we look at its amount, nature and sensitivity, potential risk of harm from unauthorised use or disclosure, the processing purposes, if these can be achieved by other means and legal requirements.

For tax purposes the law requires us to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for seven years after they stop being customers.

In some circumstances we may make anonymous your personal data for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

7. YOUR LEGAL RIGHTS  Under data protection laws you have rights in relation to your personal data that include the right to request access, correction, erasure, restriction, transfer, to object to processing, to portability of data and (where the lawful ground of processing is consent) to withdraw consent.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, you may be charged a reasonable fee if your request is clearly unfounded, repetitive or excessive or refuse to comply with your request in these circumstances.

Specific information may be needed from you to help confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. You may also be contacted to ask you for further information in relation to your request to speed up a response.

Legitimate requests within one month are generally responded to. Occasionally it may take longer than one month if your request is particularly complex or you have made a number of requests. In this case, you will be notified. 

If you are not happy with any aspect of how TBMed has collected and used your data, you have the right to complain to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk). Before doing so, TBMed will be grateful to attempt resolving the matter first however.  

8. THIRD-PARTY LINKS  The website(s) may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, you are encouraged to read the privacy notice of every website you visit.

If you disable or refuse cookies, please note that some parts of the website(s) may become inaccessible or not function properly. TBMed’s website(s) are hosted by GoDaddy.com which is GDPR compliant.
